Regional Forum for Southeast Asian Lawyers and Public Interest Advocates
On 30 November 2023, Legitima Law Firm Managing Partner, Febio Nesta, was entrusted with facilitating a meeting of lawyers and public interest advocates affiliated with The Southeast Asian Public Interest Lawyers (SEAPIL) network in Cebu, Philippines.
The appointment reflected Febio Nesta’s extensive experience in legal aid and pro bono legal services in Indonesia. The meeting was organized by the Indonesian Legal Aid Foundation (YLBHI), acting as the SEAPIL Secretariat, and took place one day before the 12th Asia Pro Bono Conference, which was held at the same venue.
Participation from Across Southeast Asia
The SEAPIL forum brought together lawyers and activists representing several Southeast Asian countries, including:
- Indonesia
- Philippines
- Malaysia
- Myanmar
- Laos
- Cambodia
Meanwhile, several lawyers from Vietnam and Singapore were unable to attend due to ongoing criminalization issues related to their professional activities in their respective countries.
The participation of representatives from different jurisdictions created an opportunity to exchange experiences and perspectives on the challenges faced by lawyers and public interest defenders throughout the region.
Addressing Challenges Faced by Public Interest Lawyers
One of the key topics discussed during the meeting was the range of obstacles encountered by lawyers and public interest advocates in carrying out their professional responsibilities.
Participants examined various risks associated with their work, including threats of violence, intimidation, and criminalization directed at lawyers engaged in legal aid services and public interest advocacy.
The discussion also served as a platform to identify common challenges across different countries and explore approaches that could contribute to stronger protections for legal professionals throughout Southeast Asia.
Recommendations to Strengthen Lawyer Protection
As an outcome of the meeting, participants formulated several recommendations aimed at enhancing protections for lawyers, particularly those working in legal aid, human rights advocacy, and public interest law.
One of the principal recommendations emphasized the importance of strengthening legal safeguards and professional immunity for lawyers so they can perform their duties freely and independently.
This recommendation was based on the need to ensure that lawyers are able to provide legal services, represent clients, and fulfill their professional obligations without fear of violence, intimidation, or unjust criminalization.
The Importance of Protecting Lawyers in a Rule of Law System
The protection of lawyers is a fundamental component of any justice system that upholds the rule of law and guarantees access to justice. In public interest work, lawyers frequently engage with issues involving vulnerable communities, human rights concerns, and matters affecting the broader public.
For this reason, strengthening protections for the legal profession continues to be an important topic in both regional and international legal forums.
