Regional Discussion on Challenges to Judicial Independence
On Wednesday, 28 February 2024, Legitima Law Firm took part in a regional consultation held with the United Nations Special Rapporteur on the Independence of Judges and Lawyers, Ms. Margaret Satterthwaite.
The consultation formed part of a broader series of discussions supporting the preparation of a thematic report on safeguarding the independence of judicial systems in the face of contemporary challenges to democracy.
The forum brought together a range of stakeholders to examine issues affecting the independence of judicial institutions and legal professionals across different countries and regions.
Concerns Over Criminal Liability Faced by Lawyers in the Course of Legal Representation
During the consultation, Febi Yonesta, Managing Partner of Legitima Law Firm, raised concerns regarding the risk of criminal prosecution faced by lawyers while carrying out their professional duties in representing clients.
He highlighted situations in which lawyers providing legal assistance may become subject to allegations under provisions relating to obstruction of justice.

In his presentation, Febi Yonesta emphasized that the Advocates Law provides safeguards for lawyers in the performance of their professional responsibilities.
These protections include the freedom to express legal opinions, access information necessary for legal representation, and undertake lawful defense measures on behalf of their clients.
Such guarantees play a crucial role in ensuring that lawyers can perform their professional functions independently and without undue interference or pressure.
The Importance of Safeguarding the Independence of the Legal Profession
